Summary

Israeli violations of international law and international humanitarian law in the oPt continued during the reporting period (14 – 21 November 2012). The first attack was conducted on Wednesday, 14 November 2012, when IOF extra-judicially executed the leader of Ezz Eddin al-Qassam Brigades (the military wing of Hamas movement), Ahmed al-Ja'bari, and his bodyguard. A comprehensive offensive was then launched on civil and military targets throughout the Gaza Strip. As a result, hundreds of Palestinian civilians, including a big number of children, women and elderly, were killed and wounded. Moreover, dozens of houses were destroyed and hundreds of others sustained damages, in addition to the destruction of governmental and private establishments. Several hours before the issuance of this weekly report, a ceasefire agreement was reached between IOF and the Palestinian resistance movements under the auspices of Egypt.

In the West Bank, dozens of protests were organized against the Israeli offensive on the Gaza Strip, where IOF used excessive force to disperse them. As a result, 2 Palestinian civilians were killed and dozens of others were wounded.

As part of the pattern of using excessive force against peaceful protests organized by Palestinian civilians, IOF used force to disperse demonstrators protesting against the annexation wall and settlement activities in the West Bank.

Israeli settlers in the West Bank have continued to commit crimes against Palestinian civilians. These attacks are conducted under the incitement of the Israeli government, encourages settlers to conduct more attacks in presence of Israeli soldiers, who offer protection to them. In addition, the Israeli government neglects to carry out investigations after complaints are filed by the Palestinian civilians against the settlers. These attacks are carried out in with the entire world as a witness and an Arab world and larger international community that remains silent, due to which Israel continues to commit more crimes, promoting the perception of Israel as a state above the law.

Shooting and shelling incidents:

During the reporting period, IOF launched a new offensive on the Gaza Strip that started at 14:45 on Wednesday, 14 November 2012, and ended at approximately 21:00 on Wednesday, 21 November 2012. The offensive ended as a result of an agreement that was reached between the Israeli government and Palestinian resistance groups under the auspices of Egypt.

Similar to the Israeli offensive on the Gaza Strip (‘Operation Cast Lead’) in 2008-2009, the main victims of this recent offensive were civilians. Hundreds of civilians, the majority of whom were children and women, were killed and wounded. Furthermore, entire families passed away under the rubble of their houses, which were cruelly and intentionally shelled by IOF. This offensive increased the suffering of the Palestinian civilians in the Gaza Strip, which has been under an Israeli imposed illegal closure for 6 years, due to which the reconstruction of the Gaza Strip following ‘Operation Cast Lead’ was hindered.

During the 8-day Israeli offensive IOF, especially warplanes, attacked the entire Gaza Strip, leaving no place to be safe. IOF targeted houses, destroyed them completely, in addition to targeting other civilian objects, governmental establishments, police stations, mosques, schools, hospitals, health clinics, streets, bridges, and service centers. These targeted areas were densely populated areas, due to which the number of civilian casualties increased. Moreover, IOF intentionally and directly targeted journalists and media offices, killing 3 journalists and injuring 12 others. Numbers and statistics mentioned in this report reflect the scale of the attacks carried out during this military operation.

The Israeli offensive resulted in the killing of 156 Palestinians, including 103 civilians.  33 children, 13 women and 3 journalists were among those civilians who were killed. In addition, entire families were killed, such as 8-members of the al-Dalo family. However, until now a girl still remains under the rubble of the family house. Furthermore, the offensive resulted in the wounding of 1,000 Palestinians, including 971 civilians. 274 children, 163 women and 12 journalists were among the civilians who were wounded.

During the offensive, IOF carried out 1,350 air strikes, in which 1,400 missiles were launched, in addition to artillery shells fired by land and naval forces. The Israeli attacks resulted in the following:

55 houses were completely destroyed, while hundreds of other houses sustained damages ranging between extensive damage and partial damage.

2 mosques were completely destroyed, while other 34 mosques sustained partial or extensive damage;

8 governmental establishments were destroyed, the most prominent of which were the Prime Minister's head office and the Governmental Compound (Abu Khadra) in Gaza City;

13 security offices and police stations were destroyed, the most prominent of which was the Police Headquarter in Gaza City;

2 bridges connecting the centre of the Gaza Strip with the northern Gaza Strip were destroyed;

6 media offices and 6 health institutions were targeted;

28 educational institutions sustained major damage.

II: The West Bank:

During the reporting period, IOF killed 2 Palestinian civilians, injured another 122, including 31 children, a woman, and a paramedic. The killing of the 2 civilians and injury of 115 others happened during peaceful demonstrations protesting the Israeli offensive on the Gaza Strip, while 4 civilians, including two children, were injured during Israeli incursions, and 3 other civilians, including a child, were injured in peaceful demonstrations protesting the Annexation Wall and Settlement Activity.

In the wake of IOF's assassination of Ahmed al-Ja'bari, Commander of the al-Qassam Brigades, the military wing of Hamas, on Wednesday evening, 14 November 2012, the West Bank witnessed a wide scale popular movement throughout its cities. IOF used excessive force against these peaceful demonstrations. As a result, two Palestinian civilians were killed, 102 sustained injuries, including 21 children, a woman and a paramedic.

During incursions conducted by IOF during the reporting period, 4 Palestinians, including 2 children, sustained wounds. On Friday, 15 November 2012, a child sustained wounds in al-Tabka village, west of Doura, southwest of Hebron, when IOF moved into the village. Another civilian was wounded in al-Nouba village, west of the city. On Saturday, 17 November 2012, a child sustained wounds when IOF moved into al-'Aroub Refugee Camp, north of Hebron. On 20 November 2012, IOF arrested the child from his home. On Sunday, 18 November 2012, a Palestinian civilian was injured in Beit Umar village, north of Hebron, when IOF moved to the village. They also arrested his brother, a physically disabled ex-prisoner. According to eyewitnesses, the injured civilian went out to see where IOF were leading his brother when they fired at him, injuring him in the back and shoulder. They also beat him severely before transporting him with an IOF ambulance.

In the same sense, IOF continued to systematically use excessive force against peaceful demonstrations, organized by Palestinian, Israeli and international human rights activists, protesting the continued construction of the annexation wall and settlement activity in the West Bank. As a result, 3 Palestinian civilians sustained wounds. In Bil’ein village, west of Ramallah, Adeib Abu Rahmah, 41, member of the Popular Committee against the Wall and Settlement Activity, was hit by a tear gas canister to the right foot, while his son, Ahmed Adeib Abu Rahmah, 12, was injured with a metal bullet to the back. Also in Kufor Qaddoum village, northeast of Qalqilya, a civilian sustained an injury in the head by a gas canister, and dozens of demonstrators sustained bruises and suffered from tear gas inhalation.

Incursions

IOF continues to raid Palestinian communities in the West Bank and to arrest Palestinian civilians on a daily basis throughout the territory. During the reporting period, the IOF conducted at least 77 military incursions into Palestinian communities in the West Bank.  During these incursions, the IOF arrested at least 76 Palestinians, including 6 children.

Among the arrested civilians was Tha'er Halahla, an ex-prisoner, who was taken from his home in Kharas village, west of Hebron, on Friday 16 November 2012. Halahla has gone through a 78-day hunger strike in protest to being administratively detained, before being released. Also on Friday, IOF arrested a Palestinian civilian from Beit Umar village, north of Hebron, after injuring him, and also arrested a child from al-'Aroub Refugee Camp, north of the city, days after being injured by IOF.

From PCHR’s documentation of Israeli violations against Palestinian civilians and their property in the West Bank, it becomes clear that IOF deliberately abuses, tortures and terrorizes Palestinian civilians by raiding their houses and inflicting material damages to their property.

Restrictions on Freedom of  Movement

Israel continued to impose a tightened closure on the oPt, maintaining severe restrictions on the movement of Palestinian civilians in the Gaza Strip and the West Bank, including occupied East Jerusalem.

The illegal Israeli-imposed closure of the Gaza Strip, which has steadily tightened since June 2007, has had a disastrous impact on the humanitarian and economic situation in the Gaza Strip. The illegal closure has caused not only a humanitarian crisis but a crisis of human rights and human dignity for the people of the Gaza Strip.  Recently-declared measures to ease the closure are vague, purely cosmetic and fail to deal with the root causes of the crisis; the root causes can only be addressed by an immediate and complete lifting of the closure, including lifting the travel ban in place for people seeking to travel into and out of the Gaza Strip, and the ban on exports.  Palestinians in Gaza may no longer suffer from the same shortage of goods but, as long as the closure is allowed to continue, they will remain economically dependent, unable to care for themselves, and socially, culturally and academically isolated from the rest of the world.

IOF have continued to impose severe restrictions on the movement of Palestinian civilians throughout the West Bank, including occupied East Jerusalem.  Thousands of Palestinian civilians from the West Bank and the Gaza Strip continue to be denied access to Jerusalem.

Along with the use of military checkpoints to obstruct the movement of the Palestinian civilians, especially between the cities and on both ends of the Annexation wall, IOF also engages in various actions to abuse them. These checkpoints are considered a trap used for arresting the Palestinian civilians, as IOF arrests civilians on an almost daily basis at checkpoints and border crossings.

Israel has continued its settlement activities in the oPt, in violation of international humanitarian law, and Israeli settlers have continued to attack Palestinian civilians and property.

At approximately 13:00 on Saturday, 17 November 2012, 7 settlers, one of whom was armed with an M16 firearm, from “Yitzhar” settlement, which was established on lands of ‘Ourif village, south of Nablus, stormed the village and positioned themselves near ‘Ourif High School. Upon seeing them, civilians began throwing rocks at them to stop them from entering the village. Immediately, Israeli forces, accompanied by 4 military vehicles and an armored personnel carrier, moved into the village and began firing gas canisters at the crowd, chased them, arrested 2 civilians, Walid Mohammad Salem al-Safadi (22) and Ahmed Samir Atta Sabbah (17), and transported them to an unknown destination.

At approximately 03:00 on Monday, 19 November 2012, a group of settlers coming from “Yitzhar” settlement, mentioned above, set the entrance of al-Omahat mosque on fire. The mosque is on the eastern side of ‘Ourif village, near ‘Ourif High School for Boys. Local civilians awoke to the smell of smoke and rushed to the mosque. They were able to put out the fire with water before it reached the inside of the mosque. However, the fire burned the carpeting at the entrance of the mosque.

At approximately 07:00 on Wednesday, 21 November 2012, a group of settlers coming from "Nejahot" settlement, established on the lands of Palestinian civilians east of Doura, southwest of Hebron, attacked the car of Khaled Souliman Hassan al-Sowayty (34) with rocks while driving through a street nearing the aforementioned settlement. As a result, the car windows were broken and al-Sowayty sustained minor injuries. He was transported to al-Ahly Hospital in Hebron by a PRCS ambulance.

Recommendations to the International Community

1. PCHR calls upon the High Contracting Parties to the Fourth Geneva Convention to fulfill their legal and moral obligations under Article 1 of the Convention to ensure Israel's respect for the Convention in the Occupied Palestinian Territory.  PCHR believes that the conspiracy of silence practiced by the international community has encouraged Israel to act as if it is above the law and encourages Israel continue to violate international human rights and humanitarian law.

2. PCHR calls upon the High Contracting Parties to the Fourth Geneva Convention to convene a conference to take effective steps to ensure Israel's respect of the Convention in the OPT and to provide immediate protection for Palestinian civilians.

3. PCHR calls upon the High Contracting Parties to the Fourth Geneva Convention to comply with their legal obligations detailed in Article 146 of the Convention to search for and prosecute those responsible for grave breaches, namely war crimes.

4. PCHR calls for the immediate implementation of the Advisory Opinion issued by the International Court of Justice, which considers the construction of the Annexation Wall inside the West Bank illegal.

5. PCHR recommends that international civil society organizations, including human rights organizations, bar associations and NGOs, participate in the process of exposing those accused of grave breaches of international law and urge their governments to bring the perpetrators to justice.

6. PCHR calls upon the European Union to activate Article 2 of the Euro-Israel Association Agreement, which provides that Israel must respect human rights as a precondition for economic cooperation between the EU states and Israel.  PCHR further calls upon the EU states to prohibit import of goods produced in illegal Israeli settlements in the OPT.

7. PCHR calls on the international community to recognize the Gaza disengagement plan, which was implemented in September 2005, for what it is - not an end to occupation but a compounding of the occupation and the humanitarian crisis in the Gaza Strip.

8. In recognition of ICRC as the guardian of the Fourth Geneva Convention, PCHR calls upon the ICRC to increase its staff and activities in the OPT, including the facilitation of family visitations to Palestinian prisoners in Israeli jails.

9. PCHR appreciates the efforts of international civil society, including human rights organizations, bar associations, unions and NGOs, and urges them to continue their role in pressuring their governments to secure Israel's respect for human rights in the OPT and to demand Israel end its attacks on Palestinian civilians.

10. PCHR calls upon the international community to pressure Israel to lift the severe restrictions imposed by the Israeli government and its occupation forces on access for international organizations to the OPT.

11. PCHR reiterates that any political settlement not based on international human rights law and humanitarian law cannot lead to a peaceful and just solution of the Palestinian question.  Rather, such an arrangement can only lead to further suffering and instability in the region.  Any peace process or agreement must be based on respect for international law, including international human rights and humanitarian law.
