Stop the collective punishment of civilians in Gaza

The Euro-Mediterranean Human Rights Network strongly condemns the decision by the Israeli government to cut off vital supplies of electricity and fuel as well as essential foodstuffs, medicines and other humanitarian supplies to the civilian population of Gaza.

Since Friday 18 January, Israel has closed all Gaza’s border crossing points and blocked all humanitarian aid, except for emergency cases. With some 80 percent of Gaza’s population requiring food aid, the impact of these measures will be catastrophic. This escalation has also been accompanied by an intensifying of Israeli military attacks on the Gaza Strip in the first 19 days of 2008, costing the lives of 69 Palestinians, including four children and eight women, and the injury of over 190.

Israeli military forces continue to launch indiscriminate attacks on densely populated areas of Gaza Strip, where it is impossible to distinguish between civilians and military objects. This disproportional use of force puts the lives of Palestinian civilians at high risk.

Israel’s current policy in relation to the Gaza Strip and its 1.5 million inhabitants constitutes a violation of international humanitarian law including Israel’s obligation as an Occupying Power to ensure, at a minimum, the basic needs of the population under its effective control, and the prohibition on collective punishment contained in the Fourth Geneva Convention.

ü       Recalls that the root cause to the current situation is Israeli occupation of the Palestinian territories which is illegal according to UN Security Council resolutions.

ü       Condemns the closure of Gaza; the toppling of the fence at the Egyptian border implies no release of Israel from its responsibilities as an occupying power.

ü       Calls upon Israel to cease immediately any military action endangering the life of the civil populations inside the Gaza Strip.

ü       Calls upon the Hamas, which controls the Palestinian institutions in the Gaza Strip, to put an end to the shootings of rockets against the Israeli civilians

ü       Urges the Egyptian government to keep the border open

ü       Demands from the parties of the Israeli-Palestinian conflict to strictly observe the regulations of the international law and the international humanitarian law.

ü       Calls upon the international community and the EU member states to fully comply with their obligations of safeguarding international human rights standards and international humanitarian law.

ü       Calls upon EU to take concrete measures to ensure Israel’s compliance with international law, including international humanitarian law and relevant EU guidelines.

Mettre un terme à la punition collective des civils à Gaza

Le Réseau Euro-Méditerranéen des Droits de l’Homme condamne vigoureusement la décision du gouvernement israélien de couper les approvisionnements essentiels en électricité et en essence ainsi qu’en médicaments et matériels humanitaires à destination de la population de la bande de Gaza.

Depuis le 18 janvier dernier, Israël a fermé tout les points de passage aux frontières de Gaza et a bloqué toute aide humanitaire sauf cas exceptionnels. Avec environ 80 pour cent de la population de Gaza ayant besoin de cette aide, il est certain que l'impact de ces mesures sera catastrophique. Cette escalade a été également accompagnée d'une intensification des attaques militaires israéliennes sur la bande de Gaza dans les 19 premiers jours de 2008, ce qui a coûté la vie à 69 Palestiniens, dont quatre enfants et huit femmes.  Les forces militaires israéliennes continuent à lancer des attaques aveugles sur des secteurs fortement peuplés, où il est impossible de distinguer les civils des militaires. Cette utilisation disproportionnelle de la force met les vies des civils palestiniens en péril.

La politique actuelle d'Israël par rapport à la bande de Gaza et à ses 1.5 million d'habitants constitue une violation du droit humanitaire international : En tant que puissance d’occupation, Israël a en effet l’obligation d'assurer, au minimum, les besoins de base de la population sous son contrôle et la quatrième convention de Genève interdit toute punition collective.

ü       Rappelle que la racine de la situation actuelle est l’occupation des Territoires Palestiniens par Israël. Occupation illégale selon des résolutions du Conseil de sécurité de l'ONU. 

ü       Condamne le blocus de Gaza ; La fermeture de la frontière égyptienne implique qu'Israël ne peut aucunement se décharger de ses responsabilités en tant que puissance d’occupation. 

ü       Demande á Israël de cesser immédiatement les actions militaires mettant en danger la vie des populations civiles à l'intérieur de la bande de Gaza.

ü       Demande au Hamas, qui contrôle les institutions palestiniennes dans la bande de gaza, à faire cesser les tirs de roquettes contre les civils israéliens

ü       Demande au gouvernement égyptien de garder sa frontière ouverte

ü       Appelle toutes les parties prenantes au conflit israélo-palestinien à observer fidèlement les règles du droit international et du droit humanitaire international

ü       Appelle la communauté internationale et les Etats membres de l’Union européenne à se conformer strictement à leurs obligations de sauvegarde des normes internationales en matière de droits de l'Homme et de droit humanitaire international

ü       Apelle l'UE à agir afin de mettre un terme à la punition collective imposée aux civils de Gaza
