Weekly Report: On Israeli Human Rights Violations in the Occupied Palestinian Territory

Israeli Occupation Forces Continue Systematic Attacks against Palestinian Civilians and Property in the Occupied Palestinian Territory (OPT)

 

 

 


 

Summary

Israeli violations of international law and humanitarian law continued in the OPT during the reporting period (14 – 20 January 2010):

 

Shooting: During the reporting period, IOF wounded 9 Palestinian civilians, including two children and 3 journalists, in the West Bank. 

Seven Palestinian civilians, including 3 journalists, were wounded when IOF used force to disperse peaceful demonstrations organized by Palestinian civilians and international and Israeli human rights defenders, in protest of the construction of the Annexation Wall in the West Bank.

On 16 January 2010, a child was wounded in Yatta village, south of Hebron, while playing with an old explosive left in the area by IOF. 

On 19 January 2010, a child was wounded when IOF moved into Jenin refugee camp in the northern West Bank and fired at a number of children who demonstrated in the area.  

Two Palestinian civilians, including a child, were also wounded by Israeli troops stationed at military checkpoints. 

 

Incursions: During the reporting period, IOF conducted at least 22 military incursions into Palestinian communities in the West Bank.  IOF arrested 34, including 4 children.  Israeli forces also stormed houses of activists working against the construction of the Annexation Wall.    

 

Restrictions on Movement: Israel has continued to impose a tightened closure on the OPT and imposed severe restrictions on the movement of Palestinian civilians in the Gaza Strip and the West Bank, including occupied East Jerusalem.

 

Gaza Strip

Israel has continuously closed all border crossings to the Gaza Strip over two and a half years. The illegal Israeli-imposed siege of Gaza, which has steadily tightened since June 2007, has had a disastrous impact on the humanitarian and economic situation in the Gaza Strip.

·      1.5 million people are being denied their basic rights, including freedom of movement, and their rights to appropriate living conditions, work, health and education.

 

·      The main concern of 1.5 million people living in the Gaza Strip is to obtain their basic needs of food, medicines, water and electricity supplies.

 

·      Israel has continued to prevent the entry of raw construction materials into the Gaza Strip for the past two and a half years.

 

·      Israel has not allowed fuel supplies into the Gaza Strip, excluding limited amounts of cooking gas, since 10 December 2008.

 

·      The Rafah International Crossing Point has been opened for a few days for a number of patients who received medical treatment abroad and needed to return to the Gaza Strip.

·      Israel has continued to close Beit Hanoun (Erez) crossing to Palestinian civilians wishing to travel to the West Bank and Israeli for medical treatment, trade or social visits.

 

·      Living conditions of the Palestinian civilian population have seriously deteriorated; levels of poverty and unemployment have sharply mounted.

 

·      IOF have continued to prevent the entry of spare parts form water networks and sewage systems. Losses incurred to this sector are estimated at US$ 6 million.

 

·      Israel has imposed additional restrictions on access of international diplomats, journalists and humanitarian workers to the Gaza Strip. They have prevented representatives of several international humanitarian organizations from entering the Gaza Strip.

 

·      Palestinian prisoners from Gaza in Israeli jails have been deprived for family visitation for more than two and a half years. 

 

·      IOF have continued to attack Palestinian fishermen along the Gaza Strip coast.

 

West Bank

IOF have continued to impose severe restrictions on the movement of Palestinian civilians throughout the West Bank, including occupied East Jerusalem. Thousands of Palestinian civilians from the West Bank and the Gaza Strip continue to be denied access to Jerusalem.

·      IOF have established checkpoints in and around Jerusalem, severely restricting Palestinian access to the city. Civilians are frequently prevented from praying at the al-Aqsa Mosque in Jerusalem.

 

·      There are approximately 630 permanent roadblocks, manned and unmanned checkpoints across the West Bank. In addition, there are some 60-80 ‘flying’ or temporary checkpoints erected across the West Bank by IOF every week.

 

·      When complete, the illegal Annexation Wall will stretch for 724 kilometers around the West Bank, further isolating the entire population. 350 kilometers of the Wall have already been constructed. Approximately 99% of the Wall has been constructed inside the West Bank itself, further confiscating Palestinian land.

 

·      At least 65% of the main roads that leads to 18 Palestinian communities in the West Bank are closed or fully controlled by IOF (47 out of 72 roads).

 

·      There are around 500 kilometers of restricted roads across the West Bank. In addition, approximately one third of the West Bank, including occupied East Jerusalem, is inaccessible to Palestinians without a permit issued by the IOF. These permits are extremely difficult to obtain.

 

·      IOF continue to harass and assault demonstrators who hold peaceful protests against the construction of the Annexation Wall.

 

·      Palestinian civilians continue to be harassed by IOF in Jerusalem, and across the West Bank, including being regularly stopped and searched in the streets by IOF.

Measures Aimed at Creating a Jewish Demographic Majority in Jerusalem: On 14 January 2010, IOF forced Haoroun Zakaria Burqan, 39, to demolish his 45-square-meter house and two animal sheds.  The house, in which 8 individuals used to live, was built 5 years ago.  IOF ordered the demolition of the house 3 years ago and imposed a fine of 5,000 NIS (approximately US$ 1,250). 

During the reporting period, IOF continued excavations in the old city of Jerusalem.  According to residents of Silwan village and the old city, a ground collapse took place in the Wadi Hilwa area, on the main road between Silwan village and the old city on Monday, 18 January 2010.  The collapse created a crater with a  depth of more than 10 meters.  The collapse took place in a tunnel that was being created by Israeli excavations to link Silwan and "Givati" settlement.

 

Settlement Activities: Israel has have continued settlement activities and Israeli settlers living in the OPT in violation of international humanitarian law have continued to attack Palestinian civilians and property.

On 14 January 2010, a number of Israeli settlers from "Gilad" settlement, northeast of Qalqiliya, burned two cars and a tractor belonging to Palestinian civilians from Ematin village, east of Qalqiliya. 

On the same day, Israeli settlers living in the "Havat Ma'oun" settlement outpost to the east of Yatta village, south of Hebron, uprooted 70 olive trees in the east of al-Twana village. 

On 19 January 2010, IOF demolished a house in Jaba' village, northeast of Jerusalem, claiming that it was built without a license.

On the same day, Israeli settlers, escorted by IOF, moved into 'Awarta village, south of Nablus.  They headed to the 'Eizairat area, which they claim is sacred, and performed prayers until the following morning.  When the settlers and IOF left the village, Palestinian civilians found that the cemetery of the village had been desecrated and that 3 grave stones were destroyed.  They also found hostile phrases in Arabic and Russian.  

 

 

Israeli Violations Documented during the Reporting Period (14 – 20 January 2010)

Thursday, 14 January 2010  

·      At approximately 00:00, IOF moved into Beit 'Awa village, southwest of Hebron.  They raided and searched a house belonging to the family of Mohammed Ahmed Masalma, 33, and arrested him.

 

·      At approximately 01:00, IOF raided and searched another house in Beit 'Awa, belonging to the family of Qussai Fakhri Hassan, 15, and arrested him.

 

·      At approximately 01:30, IOF moved into Dura village, southwest of Hebron.  They raided and searched a house belonging to the family of Bajes Salama Salhoub, 35, and arrested him.

 

·      At approximately 02:00, IOF moved into al-Far'a Refugee Camp, south of Tubas.  They raided and searched a number of houses and arrested two Palestinian civilians:

 

1.    Mahmoud Jaber Abu Siam, 35; and

2.    Hussam Jom'a Qar'awi, 27.

 

·      Also at approximately 02:00, IOF moved into Saida village, north of Tulkarm.  They raided and searched a number of houses and arrested two Palestinian civilians:

 

1.    Ahmed Mohammed Raddad, 19; and

2.    Mohammed Waleed Raddad, 22.

 

·      At approximately 03:30, IOF moved into Hazma village, north of Tulkarm.  They raided and searched a house belonging to Farouq Najeeb Saladin and arrested two of his sons:  'Odai, 20; and Mohammed, 18.

 

·      At approximately 18:00, IOF moved into Maithaloun village, southeast of Jenin.  They raided and searched a number of houses, but no arrests were reported.

 

Friday, 15 January 2010

 

·      At approximately 01:00, IOF moved into al-Ma'sara village, south of Bethlehem.  They raided and searched a number of houses, including that of Mahmoud Zawahra, the mayor and head of the Popular Committee Against the Wall and Settlements, and Mohammed Braijiya, member of the local council and spokesman of the Popular Committee Against the Wall and Settlements.  No arrests were reported.

 

Saturday, 16 January 2010

·      At noon, Saleh Ahmed al-Hathalin, 12, was wounded by the explosion of a suspicious object in Yatta village, south of Hebron.  According to investigations conducted by PCHR, at approximately 12:00, al-Hathalin was playing near his house in Khashm al-Daraj area.  Soon, a suspicious object exploded near him.  He was wounded by shrapnel to the abdomen and the left hand.  According to the Palestinian police, the child was wounded when he played with an old explosive device left in the area by IOF.

·      At approximately 01:30, IOF moved into Nablus and the neighboring 'Ein Beit al-Maa' Refugee Camp.  They raided and searched a number of houses and arrested 7 Palestinian civilians, including 3 children:

 

1.    Muhannad Maher al-Shalabi, 17;

2.    Jihad Maher al-Shalabi, 23;

3.    Shadi Maher al-Shalabi, 19;

4.    Mo'tassem Saleh Khabbas, 17;

5.    Mo'tassem Ahmed Hamdi, 16;

6.    Ra'ed Mohammed al-Khatib, 19; and

7.    Samer Ahmed al-Salhi, 18.

 

·      Also at approximately 01:30, IOF moved into Balata Refugee Camp, east of Nablus.  They raided and searched a number of houses and arrested two Palestinian civilians:

 

1.    Saleem Faisal Abu Shaheen, 18; and

2.    Ibrahim 'Ata Abu Saltah, 18.

 

·      At approximately 02:00, IOF moved into Beit Ummar village, north of Hebron.  They raided and searched a number of houses and arrested Muntasser 'Abdul Hamid 'Awadh, 18.

 

Monday, 18 January 2010

·      At approximately 01:30, IOF moved into Ne'lin village, west of Ramallah.  They raided and searched a number of houses and arrested 5 Palestinian civilians:

 

1.    Muntasser Fadel al-Khawaja, 20;

2.    Mohammed 'Essam al-Khawaja, 22;

3.    Shihab Mohammed Khawaja, 19;

4.    Eihab Mohammed 'Amira, 22; and

5.    Murad 'Abdullah 'Amira, 22.

 

·      At approximately 02:30, IOF moved into Beit Diqqu village, northwest of Jerusalem.  They raided and searched a number of houses and arrested 4 Palestinian civilians:

 

1.    'Ali Mohammed Daoud, 32;

2.    Mohammed 'Abdul Khaliq Daoud, 35;

3.    Yousef 'Abdul 'Aziz Daoud, 32; and

4.    Khaled Bassam Daoud, 25.

 

Tuesday, 19 January 2010

·      At approximately 00:00, IOF moved into Jenin Refugee Camp.  They positioned themselves near a house belonging to the al-Sa'di family.  A number of Palestinian children gathered and threw stones at Israeli military vehicles.  Immediately, Israeli troops fired at the children.  As a result, Islam Hussam al-Tubassi, 17, was hit by a tear gas canister, which caused burns to his chest.

 

·      At approximately 00:30, IOF moved into Beit 'Awa village, southwest of Hebron.  They raided and searched a number of houses and arrested two Palestinian civilians:

 

1.    Mohammed 'Abdul Hamid Masalma, 24; and

2.    Tha'er Na'im Masalma, 20.

 

·      At approximately 01:00, IOF moved into Ethna village, southwest of Hebron.  They raided and searched a number of houses and arrested 'Ali Mohammed al-Jayawi, 22.

 

·      At approximately 01:30, IOF moved into Sa'ir village, east of Hebron.  They raided and searched a number of houses and arrested two Palestinian civilians:

 

1.    'Abdul Fattah Hussein Shalalda, 63;

2.    Ziad 'Abdul Fattah Husseein Shalalda, 35.

 

·      At approximately 03:00, IOF moved into Nablus.  They raided and searched a number of houses and arrested Ma'ath Rassem Saleem, 22.

 

·      At approximately 03:30, IOF moved into Bourqin village, west of Jenin.  They raided and searched a number of houses, but no arrests were reported.

 

·      Also at approximately 03:30, IOF moved into Bir al-Basha village, south of Jenin.  They raided and searched a number of houses, but no arrests were reported.

 

Wednesday, 20 January 2010

·      At approximately 01:00, IOF moved into the Jabal Abu Rumman area in Hebron.  They raided and searched a number of houses and summoned 5 Palestinian civilians for interrogation.

 

·      At approximately 02:00, IOF moved into Maithaloun village, southeast of Jenin.  They raided and searched a number of houses, but no arrests were reported.

 

 

2.      Continued Siege on the OPT

IOF have continued to impose a tightened siege on the OPT and imposed severe restrictions on the movement of Palestinian civilians in the Gaza Strip and the West Bank, including occupied East Jerusalem.

Nahal Ouz Crossing: On Friday, 01 January 2010, IOF decided to close the crossing permanently, and to allow the entry of fuels through Karm Abu Salem (Kerem Shalom) crossing, southeast of Rafah, for security claims.      

 

Al-Mentar (Karni) Crossing: IOF partially opened the crossing on Wednesday, 13 January 2010, and allowed the entry of 1,160 tons of wheat, 1,840 tons of fodders, 25 tons of grain, and 66 tons of carob.  The crossing was opened again on Monday, 18 January 2010, the entry of 1,840 tons of wheat and 1,840  tons of fodders permitted.

 

Beit Hanoun (Erez) Crossing: IOF have continued to close Beit Hanoun (Erez) crossing for the movement of Palestinian civilians. They have allowed only diplomats, a number of international journalists, employees of international agencies, and a small number of patients who suffer from serious diseases to pass through the crossing. They have continued to prevent Palestinian civilians from visiting their relatives who are detained in Israeli jails.  As mentioned above, IOF have permitted a small number of patients to pass through the crossing, but under severe restrictions that include prolonged checking.

The West Bank

Israel has imposed a tightened siege on the West Bank. During the reporting period, IOF imposed additional restrictions on the movement of Palestinian civilians

·      Jerusalem: IOF continued to impose severe restrictions on the movement of Palestinian civilians to and from the city. Thousands of Palestinian from the West Bank and the Gaza Strip have been denied access to the city. IOF have established numerous checkpoints around and inside the city. Restrictions of the movement of Palestinian civilians often increase on Fridays, preventing Muslim Palestinians from praying at the al-Aqsa Mosque. Israeli occupation forces often violently beat Palestinian civilians who attempt to bypass checkpoints and enter the city.

 

·      Nablus:  IOF continued to impose severe restrictions on the movement of Palestinian civilians.  On Friday and Saturday, 15 and 16 January 2010, IOF established a checkpoint at the southern entrance of 'Assira village, north of Nablus.  They stopped and searched Palestinian civilian vehicles.  On Tuesday morning, 19 January 2010, Israeli troops stationed at Hawara checkpoint, south of Nablus, imposed additional restrictions on the movement of Palestinian civilians.    

 

·      Ramallah:  IOF continued to impose severe restrictions on the movement of the Palestinian civilians in Ramallah.  IOF troops positioned at Jaba' and Qalandiya checkpoints, southeast of Ramallah, imposed additional restrictions on movement and conducted prolonged checking on Palestinian civilians.  During the reporting period, IOF erected a number of temporary checkpoints, and stopped and searched Palestinian civilian vehicles.       

 

·      Jenin: IOF continued to impose severe restrictions on the movement of Palestinian civilians.  At approximately 06:00 on Friday, 15 January 2010, IOF established a checkpoint at the Sanour-Misilya intersection, southeast of Jenin.  They stopped and searched Palestinian civilian vehicles. On Saturday morning, 16 January 2010, IOF established a checkpoint on the Nablus-Jenin road, opposite the evacuated "Homseh" settlement.  Israeli forces stopped and searched dozens of Palestinian civilian vehicles.         

 

·      Tulkarm: IOF continued to impose severe restrictions on the movement of Palestinian civilians.  At noon on Friday, 15 January Israeli troops stationed at Ennab checkpoint, east of Tulkarm, imposed severe restrictions on the movement of Palestinian civilians.  They searched Palestinian civilian vehicles and verified the identity cards of passengers. 

 

·      Hebron:  IOF continued to impose severe restrictions on the movement of Palestinian civilians.  At approximately 15:00 on Monday, IOF established two checkpoints northwest of the town.  Tropos stopped and searched Palestinian civilian vehicles.  On Tuesday morning, 19 January 2010, IOF erected a checkpoint near "Karmi Tsur" settlement, north of Hebron.  They stopped and searched Palestinian civilian vehicles.

 

Arrests at Military Checkpoints

·      At approximately 10:30 on Sunday, 17 January 2010, Israeli troops stationed at the Container checkpoint, northeast of Bethlehem, arrested Ayman Na'im al-Qawasmi, 39, director of Minbar al-Horriya (Freedom Tribune) Radio in Hebron.

 

·      On Monday evening, 18 January 2010, Israeli troops stationed at a checkpoint near al-Rashaida village, southeast of Bethlehem, arrested 3 Palestinian shepherds:

 

1.    Mahmoud Mohammed al-Rashaida, 61;

2.    Ahmed Mohammed al-Rashaida, 55; and

3.    Rezeq Hamad al-Rashaida, 18.

 

·      On Tuesday morning, 19 January 2010, Israeli troops stationed at al-Hamra checkpoint, south of Tubas,a arrested 'Abdullah 'Ali Ghourani, 20, from al-Far'a Refugee Camp south of Tubas.

 

Harassments at Military Checkpoints

 

·      At noon on Saturday, 17 January 2010, Israeli troops patrolling near "Beita Elite" settlement, west of Bethlehem, stopped and violently beat Mohammed 'Abdul Halim Halahla, 35, and Mahmoud Ahmed Ramadan, 15, both from Kharas village near Hebron.  The two civilians sustained bruises all over their bodies.

 

3.     Construction of the Annexation Wall

IOF continued to construct the Annexation Wall inside West Bank territory.  During the reporting period, IOF used force against peaceful demonstrations organized by Palestinian civilians and international and Israeli human rights defenders in protest to the construction of the Wall.

 

·      Following the Friday Prayer on 15 January 2010, dozens of Palestinian civilians and international and Israeli human rights defenders gathered in the center of Bil'ein village, west of Ramallah. They moved towards the Wall and threw stones at IOF troops positioned in the area. Immediately, IOF troops fired rubber-coated metal bullets, sound bombs and tear gas canisters at the demonstrators.  Dozens of demonstrators suffered from tear gas inhalation and Bassem Ahmed Yassin, 34, sustained a fracture to the right leg as he was beaten by IOF.  Seven civilians were also wounded by rubber-coated metal bullets:

 

1.    Ibrahim 'Abdul Fattah Bernat, 22, wounded by a rubber-coated metal bullet to the right leg;

2.    Farhan Ibrahim Bernat, 21, wounded by a rubber-coated metal bullet to the right shoulder;

3.    Nayef Ghazi al-Khatib, 20, wounded by a rubber-coated metal bullet to the right leg;

4.    Fadi Mousa al-Jayousi, 29, a photographer of the local al-Ayyam Daily, wounded by a rubber-coated metal bullet to the chest;

5.    Haroun Yousef 'Amaira, 25, wounded by a rubber-coated metal bullet to the right leg;

6.    Moheeb Mohammed al-Barghouthi, 45, a photographer of the local al-Hayat al-Jadeeda Daily, wounded by a rubber-coated metal bullet to the head; and

·      Also following the Friday Prayer on 15 January 2010, dozens of Palestinian civilians and international human rights defenders organized a peaceful demonstration in Ne'lin village, west of Ramallah, in protest of the construction of the Annexation Wall.  They clashed with IOF troops positioned near the Wall.  IOF troops fired rubber-coated metal bullets, sound bombs and tear gas canisters at demonstrators.  Dozens of demonstrators suffered from tear gas inhalation.

 

·      Also following the Friday Prayer on 15 January 2010, dozens of Palestinian civilians and international human rights defenders organized a peaceful demonstration in protest of the construction of the Annexation Wall in al-Ma'sara village, south of Bethlehem.  Israeli troops closed the entrance of the village and attacked the demonstrators.  They fired sound bombs and tear gas canisters at the demonstrators and violently beat a number of them.  No casualties or arrests were reported.

 

4.      Measures Aimed at Creating a Jewish Demographic Majority in Jerusalem

 

IOF has recently escalated arbitrary measures against Palestinian civilians in East Jerusalem to pressure them to leave the city. PCHR has devoted this section in the Weekly Report to highlight violations of human rights perpetrated by IOF against Palestinian civilians in East Jerusalem.

 

·      On Thursday noon, 14 January 2010, IOF forced Haoroun Zakaria Burqan, 39, to demolish his 45-square-meter house and two animal sheds.  The house, in which 8 individuals used to live, was built 5 years ago.  IOF ordered the demolition of the house 3 years ago and imposed a fine of 5,000 NIS (approximately US$ 1,250).  At the beginning of this year, IOF ordered the demolition of the house by the family by 15 January 2010. 

 

·      During the reporting period, IOF continued excavations in the old city of Jerusalem.  According to residents of Silwan village and the old town, an ground collapse took place in the Wadi Hilwa area on the main road between Silwan village and the old town on Monday, 18 January 2010.  The collapse created a crater with a depth of more than 10 meters.  The split-collpase took place in a tunnel that was being created by Israeli excavations aiming to link between Silwan and "Givati" settlement.  This tunnel was the longest in the area.  In spite of the seriousness of the situation, IOF did not take any action.  This collapse is the second of its kind since the beginning of this year.  Such collapses are cause by excavations by IOF and the Israeli Archaeology Authority to establish a network of tunnels for settlements. 

 

·      At approximately 16:30 on Saturday, 16 January 2010, Israeli settlers attacked a number of Palestinian children in the Sheikh Jarrah neighborhood of East Jerusalem.  A female settler beat and insulted 16-year-old Aamena Munther al-Nashashibi.  Israeli police officers were present in the area, but did not intervene to stop the attack. 

 

5.      Settlement Activities and Attacks by Settlers against Palestinian Civilians and Property

 

IOF have continued settlement activities in the OPT in violation of international humanitarian law, and Israeli settlers have continued to attack Palestinian civilians and property.

 

·      At approximately 03:00 on Thursday, 14 January 2010, a number of Israeli settlers from "Gilad" settlement, northeast of Qalqiliya, attacked two cars and a tractor belonging to Palestinian civilians from Ematin village, east of Qalqiliya.  According to eyewitnesses, a white car with an Israeli registration plate was seen leaving through the entrance of Ematin village and entering "Gilad" settlement.  In the meantime, fire broke out in two cars belonging to 'Aayed 'Abdullah Sawan and Mohammed Sorour Ghanem, and a tractor belonging to Ibrahim Hassan Ghanem.  The two cars and the tractor were heavily damaged.

 

·      At noon of the same day, Israeli settlers living in "Havat Ma'oun" settlement outpost to the east of Yatta village, south of Hebron, uprooted dozens of olive trees in the east of al-Twana village.  According to Saber al-Harini, head of the local council of al-Twana village, the settlers uprooted 70 olive trees belonging to Mousa Khalil Reb'ei.

 

·      On Tuesday morning, 19 January 2010, IOF demolished a house belonging to Hassan Salem al-Ka'abna in Jaba' village, northeast of Jerusalem, claiming that it was built without a license.  According to eyewitnesses, IOF stormed a Bedouin compound in the south of Jaba' village.  They forced the Ka'abna family out of their home and demolished it.  The house was first built in 1978, and al-Ka'abna added a balcony to it in 1994.  The Bedouin compound is located near "Adam" settlement.  

 

·      At approximately 22:00 on Tuesday, Israeli settlers, escorted by IOF, moved into 'Awarta village, south of Nablus.  They headed to the 'Eizairat area, which they claim is sacred, and performed prayers until the following day morning.  When the settlers and IOF left the village, Palestinian civilians found that the cemetery of the village had been desecrated and that 3 grave stones were destroyed.  They also found hostile phrases in Arabic and Russian.

Recommendations to the International Community

1.      PCHR calls upon the High Contracting Parties to the Fourth Geneva Convention to fulfill their legal and moral obligations under Article 1 of the Convention to ensure Israel's respect for the Convention in the Occupied Palestinian Territory.  PCHR believes that the conspiracy of silence practiced by the international community has encouraged Israel to act as if it is above the law and encourages Israel continue to violate international human rights and humanitarian law 

2.      PCHR calls upon the High Contracting Parties to the Fourth Geneva Convention to convene a conference to take effective steps to ensure Israel's respect of the Convention in the OPT and to provide immediate protection for Palestinian civilians.

3.      PCHR calls upon the High Contracting Parties to the Fourth Geneva Convention to comply with their legal obligations detailed in Article 146 of the Convention to search for and prosecute those responsible for grave breaches, namely war crimes.

4.      PCHR calls for the immediate implementation of the Advisory Opinion issued by the International Court of Justice, which considers the construction of the Annexation Wall inside the West Bank illegal.

5.      PCHR recommends that international civil society organizations, including human rights organizations, bar associations and NGOs, participate in the process of exposing those accused of grave breaches of international law and  urge their governments to bring the perpetrators to justice.

6.      PCHR calls upon the European Union to activate Article 2 of the Euro-Israel Association Agreement, which provides that Israel must respect human rights as a precondition for economic cooperation between the EU states and Israel.  PCHR further calls upon the EU states to prohibit import of goods produced in illegal Israeli settlements in the OPT.

7.      PCHR calls on the international community to recognize the Gaza disengagement plan, which was implemented in September 2005, for what it is - not an end to occupation but a compounding of the occupation and the humanitarian crisis in the Gaza Strip. 

8.      In recognition of ICRC as the guardian of the Fourth Geneva Convention, PCHR calls upon the ICRC to increase its staff and activities in the OPT, including the facilitation of family visitations to Palestinian prisoners in Israeli jails.

9.      PCHR appreciates the efforts of international civil society, including human rights organizations, bar associations, unions and NGOs, and urges them to continue their role in pressuring their governments to secure Israel's respect for human rights in the OPT and to demand Israel end its attacks on Palestinian civilians.

10.  PCHR calls upon the international community to pressure Israel to lift the severe restrictions imposed by the Israeli government and its occupation forces on access for international organizations to the OPT.\

11.  PCHR reiterates that any political settlement not based on international human rights law and humanitarian law cannot lead to a peaceful and just solution of the Palestinian question.  Rather, such an arrangement can only lead to further suffering and instability in the region.  Any peace process or agreement must be based on respect for international law, including international human rights and humanitarian law
