Israeli Occupation Forces (IOF) Continue Attacks against Palestinian Civilians and Property in the Occupied Palestinian Territory (OPT) amidst a Humanitarian Crisis in the Gaza Strip Due to the Closure

 

  • 2 Palestinians, including a civilian were killed by IOF in the West Bank and the Gaza Strip.

  • 10 Palestinian civilians were wounded by the IOF gunfire and 3 others by Israeli settlers in the West Bank.

  • 4 activists of the Palestinian resistance and a woman were wounded by IOF in the Gaza Strip.

  • IOF conducted 38 incursions into Palestinian communities in the West Bank and one into the Gaza Strip.

  • IOF arrested 50 Palestinian civilians, including 14 children and a girl, in the West Bank, and 3 others, including 2 children, in the Gaza Strip.

  • IOF transformed 8 houses in Hebron into military sites.

  • IOF have continued to impose a total siege on the OPT and have isolated the Gaza Strip from the outside world.

  • The Gaza Strip is suffering a serious humanitarian crisis due to the closure of border crossings.  

  • IOF troops positioned at military checkpoints in the West Bank arrested 6 Palestinian civilians, including a child. 

  • IOF have continued to take measures aiming at the Judaization of Jerusalem.

  • IOF confiscated for the third time a tent belonging to the al-Kurd family whose house had been seized by IOF.

  • IOF have continued settlement activities in the West Bank and Israeli settlers have continued to attack Palestinian civilians and property.

  • 17 Palestinian civilians, including 5 children, were injured.

  • 4 houses were burnt and 5 cars were destroyed in Hebron

 

Summary

Israeli violations of international law and humanitarian law escalated in the OPT during the reporting period (4 – 17 December 2008):

Shooting: During the reporting period, IOF killed 2 Palestinians in the West Bank and the Gaza Strip. They also wounded 10 Palestinian civilians, including 4 children, in the West Bank, and 4 activists of the Palestinian resistance and a woman in the Gaza Strip. Additionally, 3 Palestinian civilians were wounded by Israeli settlers' gunfire.

In the West Bank, on Monday, 15 December 2008, an IOF undercover unit extra-judicially executed Jihad Ahmed Ameen Nawahda, 21, a member of the al-Quds Brigades (the armed wing of Islamic Jihad), in al-Yamoun village west of Jenin. Nawahda was hit by multiple gunshots to the back, the abdomen and the legs.

During the reporting period, 9 Palestinian civilians, including 3 children, were wounded when IOF used force against peaceful demonstrations organized in protest to the construction of the Annexation Wall west of Ramallah.

Also during the reporting period, 3 Palestinian civilians, including a man and his son, were wounded by Israeli settlers' gunfire in Hebron on 4 and 5 December 2008.

On Sunday, 12 December 2008, a Palestinian child was seriously wounded by a gunshot to the head fired by IOF troops that provided protection to Israeli settlers who attacked Palestinian civilians and property in Hebron.  

Incursions: During the reporting period, IOF conducted at least 38 military incursions into Palestinian communities in the West Bank. During these incursions, IOF arrested 50 Palestinian civilians, including 14 children and a girl. Thus, the number of Palestinian civilians arrested by IOF in the West Bank since the beginning of 2008 has mounted to 2,311. IOF also transformed 8 houses in Hebron into military sites. In the Gaza Strip, IOF troops that had moved into 'Abassan village, east of Khan Yunis, arrested 3 Palestinian civilians, including 2 children, for some hours.

Restrictions on Movement: IOF have continued to impose a tightened siege on the OPT and imposed severe restrictions on the movement of Palestinian civilians in the Gaza Strip and the West Bank, including occupied East Jerusalem. During the reporting period, IOF imposed a comprehensive closure on the OPT for the the Jewish Sukkot.

 

Gaza Strip

IOF have continued to close all border crossings to the Gaza Strip for more than two years. The IOF siege of Gaza, which has steadily tightened since June 2007, has had a disastrous impact on the humanitarian and economic situation in the Gaza Strip.

·      The Gaza Power plant completely stopped operation due to the lack of energy fuel. Over the past three weeks, IOF have allowed only 1,721,610 liters of energy fuel into the Gaza Strip, an amount which can operate the power plant for only 5 days.

 

·      The main concern of 1.5 million people living in the Gaza Strip is to obtain their basic needs of food, medicines, water and electricity supplies.

 

·      The majority of the civilian population lack access to drinking water.

 

·      Electricity is cut off for 100,000s of civilians from 8-12 hours daily, which has impacted at least 500,000 students or various stages of education who are currently having exams./

 

·      The UN Relief and Works Agency (UNRWA) was forced to suspend it humanitarian aids program for at least 750,000 Palestinian refugees in the Gaza Strip for 5 days.

 

·      Thousands of Palestinian civilians have been forced to wait in long queues to buy bread.

 

·      The Rafah International Crossing Point has been opened for a few days for a number of patients who received medical treatment abroad and needed to return home to the Gaza Strip.

 

·      IOF have continued to close Beit Hanoun (Erez) crossing in the face of Palestinian civilians wishing to travel to the West Bank and Israeli for medical treatment, trade or social visits.

 

·      IOF have imposed additional restrictions on access of international diplomats, journalists and humanitarian workers to the Gaza Strip. They have prevented representatives of several international humanitarian organizations from entering the Gaza Strip.

 

·      IOF have decreased the number of patients allowed to travel through Erez crossing to receive medical treatment in hospitals in the West Bank and Israel to an average of 17 patients daily, which marks a decrease by 15% in comparison with the first quarter of 2008.

 

·      Health conditions in the Gaza Strip have deteriorated and all medical facilities have been impacted as scores of medical sets are operated by electricity. Dozens medicines have been lacking.

 

·      The lives of newly born babies, whose development has not been completed, is endangered as they need medical equipments in neonatal units that are operated by electricity.

 

·      Living conditions of the Palestinian civilian population have seriously deteriorated; levels of poverty and unemployment have sharply mounted.

 

·      At least 900 Palestinian prisoners in Israeli jails have been deprived for family visitation for more than 16 months. 

 

West Bank

IOF have continued to impose severe restrictions on the movement of Palestinian civilians throughout the West Bank, including occupied East Jerusalem. Thousands of Palestinian civilians from the West Bank and the Gaza Strip continue to be denied access to Jerusalem.

·      IOF have established checkpoints in and around Jerusalem, severely restricting Palestinian access to the city. Civilians are frequently prevented from praying at the al-Aqsa Mosque in Jerusalem.

 

·      There are approximately permanent 630 roadblocks, manned and unmanned checkpoints across the West Bank. In addition, there are some 60-80 ‘flying’ or temporary checkpoints erected across the West Bank by IOF every week.

 

·      When complete, the illegal Annexation Wall will stretch for 724 kilometers around the West Bank, further isolating the entire population. 350 kilometers of the Wall has already been constructed. Approximately 99% of the Wall has been constructed inside the West Bank itself, further confiscating Palestinian land.

 

·      At least 65% of the main roads that leads to 18 Palestinian communities in the West Bank are closed or fully controlled by IOF (47 out of 72 roads).

 

·      There are around 500 kilometers of restricted roads across the West Bank. In addition, approximately one third of the West Bank, including occupied East Jerusalem, is inaccessible to Palestinians without a permit issued by the IOF. These permits are extremely difficult to obtain.

 

·      IOF continue to harass, and assault demonstrators who hold peaceful protests against the construction of the Annexation Wall.

 

·      Palestinian civilians continue to be harassed by IOF in Jerusalem, and across the West Bank, including being regularly stopped and searched in the streets by IOF.

 

·      During the reporting period, IOF arrested 6 Palestinian civilians, including a child, at various checkpoints in the West Bank.

Judaization of Jerusalem: IOF have escalated arbitrary measures against Palestinian civilians in East Jerusalem to force them to leave the city. During the reporting period, IOF stormed and confiscated for the third a tent set up by the al-Kurd family in Sheikh Jarrah neighborhood in East Jerusalem. It is worth noting that IOF seized Fawzia al-Kurd's house on 9 November 2008 and expelled the family from it. Since that date, Fawzia al-Kurd has lived in a tent set up near the house.

Settlement Activities: IOF have continued settlement activities and Israeli settlers living in the OPT in violation of international humanitarian law have continued to attack Palestinian civilians and property. During the reporting period, Israeli settlers living in "Kiryat Arba" and "Kharsina" settlements and settlement outposts in the southeast and the center of Hebron launched a series of systematic terrorist attacks against Palestinian civilians and property in nearby Palestinian residential areas in Hebron. IOF provided protection for settlers. The settlers used firearms, empty bottles and stones in their attacks. A number of Palestinian civilians were injured, 4 houses were burnt, 5 vehicles were destroyed and some other property was damaged.

·      At approximately 02:30, IOF moved into al-Mazra'a village, northwest of Ramallah. They raided and searched a number of houses and arrested Mohammed Shraiteh, 42.

 

Friday, 5 December 2008

·      At approximately 01:00, IOF moved into Madama village, south of Nablus. They raided and searched a number of houses, but no arrests were reported.

 

·      At approximately 22:00, an IOF aircraft fired a missile at a number of activists of the Palestinian resistance who were in al-Sikka Street to the east of Jabalya refugee camp in the northern Gaza Strip. An activist was seriously wounded.

 

Saturday, 6 December 2008

·      At approximately 02:30, IOF moved into Jenin town and refugee camp. They raided and searched a number of houses and arrested Nawal Bassam al-Sa'di, 48, the mother of 7 children, two of whom were killed by IOF. She is also the wife of Sheikh Bassam al-Sa'di, who has been detained by IOF.

 

Sunday, 7 December 2008

·      At approximately 01:30, IOF raided and searched a house belonging to Mahmoud 'Eissa al-'Obaidi in Ras al-'Aamoud neighborhood in East Jerusalem. They confiscated a computer set and a number of other electronic sets. They also violently beat the owner's son, 20-year-old Amjad, when he debated with them. He sustained bruises to the neck and the back. Before leaving the house, IOF troops arrested the owner's daughter, 21-year-old Amal.

·      At approximately 02:00, IOF moved into Kufor Hares village, north of Salfit. They raided and searched a house belonging to Zayed Mohammed Mahmoud, but no arrests were reported.

 

Tuesday, 9 December 2008

·      At approximately 01:00, IOF moved into Tulkarm. They raided and searched 2 houses belonging to the 'Awadh family and arrested Bilal Ibrahim 'Awadh, 18.

 

·      At approximately 10:00, IOF moved into Marda village, north of Salfit. They violently beat Shaker Ayoub Suleiman, 26, and his brother Mujahed, 23. The two brothers were moderately injured. According to eyewitnesses, IOF troops surprised a number of children who were playing near their houses, so the children cried. Shaker Suleiman got out of his house in order to explain to IOF troops that the children were afraid of them. Immediately, IOF troops violently beat him. When his brother intervened to discuss the matter with them, they also violently beat him. 

 

Wednesday, 10 December 2008

·      At approximately 01:00, IOF moved into 'Attil village, north of Tulkarm. They raided and searched a number of houses and arrested Fares Sami Daqqam 23.

 

·      Also at approximately 01:00, IOF moved into Saida village, north of Tulkarm. They raided and searched a number of houses and arrested 2 Palestinian civilians:

 

1.      Rassem Sa'id Raddad, 30; and

2.      Hamad Ma'rouf Hamad, 25.

 

·      At approximately 02:00, IOF moved into 'Azmout village, northeast of Nablus. They raided and searched a number of houses, but no arrests were reported.

 

·      At approximately 03:30, IOF moved into Burqa village, west of Nablus. They raided and searched a number of houses. According to eyewitnesses, IOF troops detonated a sound bomb in a room in a house belonging to Tawfiq 'Abdullah Yousef, 55. The room was completely burnt. IOF troops also smashed windows of a car belonging to Najeh Mohammed Abu 'Omar. IOF withdrew from the village a few hours later and no arrests were reported.

 

·      At approximately 15:00, an IOF infantry unit moved into Madama village, south of Nablus. IOF troops arrested 2 Palestinian civilians who were walking in the street:

 

1.      Shaheed Ghassan Ziada, 23; and

2.      Mujahed 'Abdul Karim al-Qut, 20.

 

Thursday, 11 December 2008

·      At approximately 01:00, IOF moved into Madama village, south of Nablus. They raided and searched a number of houses and arrested 5 Palestinian civilians:

 

1.      Rami Mohammed Deeb, 29;

2.      Sidqi Hussein Deeb, 34;

3.      Tha'er Sameer Deeb, 23;

4.      'Anan Nussair Nassar, 27; and

5.      Mo'tassem Nussair Nassar, 36.

 

·      At approximately 02:15, IOF moved into Jenin town and refugee camp. They raided and searched a number of houses, but no arrests were reported.

 

·      Also at approximately 01:15, IOF moved into Seilat al-Zaher village, south of Jenin. They raided and searched a number of houses, but no arrests were reported.

 

·      At approximately 20:30, IOF troops arrested 3 Palestinian civilians who were on their way to a house of one of them located 400 meters away from the border between the Gaza Strip and Israel to the east of Khan Yunis. Israeli troops set an ambush behind trees in the area and arrested the three civilians. They took them to a military post at the border and interrogated them. The three civilians were released at approximately 05:30 on the following day. They were identified as:

 

1.      Islam Mohammed Abu Tu'aima, 17;

2.      Sameer Rihab Abu Latifa, 16; and

3.      Tamer Suleiman Abu Daqqa, 20.

·      At approximately 01:45, IOF moved into Nablus. They raided and searched a number of houses and arrested Eihab Zaher al-Bireh, 33.

 

·      At approximately 12:00, IOF moved into Salfit town. A number of Palestinian children gathered in the center of the town and threw stones at IOF military vehicles. IOF troops fired rubber-coated metal bullets at the children, but no casualties were reported.

 

Saturday, 13 December 2008

·      At approximately 01:00, IOF moved into Zabbouba village, west of Jenin. They raided and searched a number of houses and arrested 4 Palestinian civilians:

 

1.      Wadee' Bassam Maqalda, 20;

2.      Mohammed Rasmi 'Abahra, 20;

3.      Yousef Jamal Ziqzaq, 18; and

4.      Munther Riad Abu 'Obaid, 25.

 

·      At approximately 19:00, IOF moved into 'Anabta village, east of Tulkarm. A number of Palestinian children gathered in the center of the town and threw stones at IOF military vehicles. IOF troops fired rubber-coated metal bullets at the children, but no casualties were reported.

·      At approximately 01:00, IOF moved into 'Arrab village, southwest of Jenin. They raided and searched a number of houses, but no arrests were reported.

 

·      Also at approximately 01:00, IOF moved into Fahma village, southwest of Jenin. They raided and searched a number of houses, but no arrests were reported.

 

·      At approximately 01:30, IOF moved into Kufor Ra'ei village, southwest of Jenin. They raided and searched a number of houses, but no arrests were reported.

 

·      At approximately 02:00, IOF moved into Deir Abu Mash'al village, northwest of Ramallah. They raided and searched a number of houses, but no arrests were reported.

 

·      At approximately 02:30, IOF moved into Bethlehem. They raided and searched a house belonging to Ibrahim Ahmed Nabahin. They brought the owner's son, who has been detained by them, to the house. No arrests were reported.

·      At approximately 01:00, IOF moved into al-'Obaidiya village, east of Bethlehem. They raided and searched a number of houses and arrested Ayman Hussein Radaida, 21.

 

·      Also at approximately 01:00, IOF moved into Dar Salah village, east of Bethlehem. They raided and searched a number of houses and arrested Mohammed 'Azmi al-Ajdal, 25.

 

·      At approximately 01:30, IOF moved into Za'tara village, southeast of Bethlehem. They raided and searched a number of houses and arrested Mohammed 'Abdullah Muhaisen, 37.

 

·      At approximately 01:45, IOF moved into Nablus and the neighboring Balata refugee camp. They raided and searched a number of houses and arrested 4 Palestinian civilians, including 3 children:

 

1.      Mohammed 'Ata Mussaimi, 18;

2.      Khaled Hussein Abu Lail, 17;

3.      Ahmed Jamal Abu Lail, 17; and

·      At approximately 23:00, IOF moved into Beit Ummar village, north of Hebron. They raided and searched a number of houses and arrested 13 Palestinian civilians, including 11 children:

·      At approximately 01:30, IOF moved into Kufor Ra'ei village, southwest of Jenin. They raided and searched a number of houses, but no arrests were reported.

 

·      Also at approximately 01:30, IOF moved into Jaba' village, south of Jenin. They raided and searched a number of houses, but no arrests were reported.

 

·      At approximately 02:00, IOF moved into 'Arraba village, southwest of Jenin. They raided and searched a number of houses, but no arrests were reported.

 

·      Also at approximately 02:00, IOF moved into Fahma village, southwest of Jenin. They raided and searched a number of houses, but no arrests were reported.

·      At approximately 02:30, IOF moved into al-Fawar refugee camp, southwest of Hebron. They raided and searched a number of houses and arrested 3 Palestinian civilians:

 

1.      Majdi 'Ali Khudairat, 23;

2.      Ahmed Yousef Bashir, 20; and

3.      Mohammed As'ad al-Shamali, 18.

 

·      At approximately 16:45, an IOF aircraft fired 2 missiles at a number of activists of the al-Quds Brigades (the armed wing of Islamic Jihad) who were preparing to launch home-made rockets at Israeli towns from al-Farta area in Beit Hanoun town in the northern Gaza Strip. Three activists were wounded. A woman living in the area, 24-year-old Suhair Anwar al-Naqla, was also wounded by shrapnel to the left ear.

·      At approximately 01:00, IOF moved into Harmala village, east of Bethlehem. They raided and searched a number of houses and arrested 5 Palestinian civilians:

 

1.      Ra'fat Nasser al-Zeer, 27;

2.      Hisham Khalil al-Zeer, 25;

3.      Marwan Khalil al-Zeer, 23;

4.      Eyad Ahmed al-Zeer, 24; and

5.      Jamal 'Aadel Mustafa, 26.

 

·      At approximately 21:00, IOF troops positioned at the border between the Gaza Strip and Israel, east of Jabalya, launched a surface-to-surface missile at a number of activists of the Palestinian resistance in Tal al-Za'tar area in the east of Jabalya town. The missile hit the garden of a house belonging to Salah 'Abdul Hadi 'Oukal, 47, when he was 'Oukal was irrigating trees. 'Oukal was instantly killed.

 

2.      Extra-Judicial Execution

On Monday, 15 December 2008, IOF extra-judicially executed Jihad Ahmed Ameen Nawahda, 21, a member of the al-Quds Brigades (the armed wing of Islamic Jihad), in al-Yamoun village west of Jenin. Nawahda was hit by multiple gunshots to the back, the abdomen and the legs.

According to investigations conducted by PCHR, at approximately 23:15 on Monday, 15 December 2008, an IOF undercover unit moved into al-Yamoun bvillage, west of Jenin, traveling in a civilian truck with a Palestinian registration plate. The truck was traveling very fast. It stopped in front of Bab al-Hara mini market near the building of the municipality in the center of the village. When the truck stopped, Jihad Ahmed Ameen Nawahda, 21, was passing near it. When he moved a few meters away, the door of the container on the back of the truck was opened, and 3 IOF soldiers – two of them were wearing civilian clothes – got out of it. They fired at Nawahda from the back. Nawahda fell down bleeding. One of the soldiers also fired at the mini market. IOF soldiers then pulled Nawahda towards the truck. They put him in the truck and withdrew from the area. At approximately 01:30 on Tuesday, 16 December 2008, IOF declared that Nawahda died from his wound.

 

3.      Continued Siege on the OPT

IOF have continued to impose a tightened siege on the OPT and imposed severe restrictions on the movement of Palestinian civilians in the Gaza Strip and the West Bank, including Occupied East Jerusalem.

 

Gaza Strip

IOF have continued to impose a siege on the 1.5 million civilians of the Gaza Strip. The border crossings of the Strip have been closed for more than two years as part of IOF’s collective punishment policy, imposing severe restrictions on the movement of civilians and goods. As a result, the territory is unable to secure its basic needs of food, medicine, and other supplies, pushing the poverty rate above 80%.

The continued Israeli ban on fuel supplies required for civilian life in the Gaza Strip has led to the paralysis of the educational sector. Healthcare facilities have registered a drop in clients due to the transport crisis, and hundreds of healthcare professionals have been unable to reach their work places.

The tightened siege has led to the collapse of the Gaza Strip economic sectors. Most production facilities have ceased to operate due to the siege and restriction on movement of goods and individuals.

With regard to Rafah International Crossing Point on the Egyptian border, the Egyptian authorities started to open it limitedly for some patients.

IOF allow a very limited number of seriously ill patients and staff of international organizations to pass through Beit Hanoun (Erez) crossing. IOF have also prevented families of at least 900 Palestinians detained in Israeli jails from visiting them since 6 June 2007. Additionally, IOF have imposed severe restrictions on access of internationals to the Gaza Strip.

The closure of border crossings deprives the Palestinian civilian population in the Gaza Strip of their right to freedom of movement, education and health. IOF have continued to impose severe restrictions on fishing in the Gaza Strip. Following the attack on IOF on 25 June 2006, IOF prevented fishing. Approximately 35,000 people in and around Gaza’s coastal communities rely on the fishing industry, including 2,500 fishermen, 2,500 support staff and their families. Fishermen have been subjected to intensive monitoring by IOF, which use helicopter gunships and gunboats to monitor the fishermen. The Oslo Accords allow Palestinian fishermen to go fishing up to 20 nautical miles away from the Gaza seashore.

·      Health conditions in the Gaza Strip have deteriorated and all medical facilities have been impacted as scores of medical sets are operated by electricity. Dozens medicines have been lacking.

 

·      The lives of newly born babies, whose development has not been completed, is endangered as they need medical equipments in neonatal units that are operated by electricity.

 

·      Living conditions of the Palestinian civilian population have seriously deteriorated; levels of poverty and unemployment have sharply mounted.

 

·      At least 900 Palestinian prisoners in Israeli jails have been deprived for family visitation for more than 16 months.

The West Bank

IOF have imposed a tightened siege on the West Bank. During the reporting period, IOF imposed additional restrictions on the movement of Palestinian civilians.

·      Jerusalem: IOF have continued to impose severe restrictions on the movement of Palestinian civilians to and from the city. Thousands of Palestinian civilians from the West Bank and the Gaza Strip have been denied access to the city. IOF have established many checkpoints around and inside the city. Restrictions of the movement of Palestinian civilians often escalate on Fridays to prevent them from praying at the al-Aqsa Mosque. IOF often violently beat Palestinian civilians who attempt to bypass checkpoints and enter the city. IOF impose severe restrictions on the movement of Palestinian civilians on Fridays to restrict their access to the al-Aqsa Mosque.

 

·      Nablus: IOF have continued to impose severe restrictions on the movement of Palestinian civilians. On Thursday evening, 4 December 2008, IOF closed Hawara road, south of Nablus, as dozens of Israeli settlers demonstrated in the area. The closure of the road continued for 2 hours. On Saturday evening, 6 December 2008, IOF closed Hawara road, south of Nablus, as dozens of Israeli settlers demonstrated in the area. During the 'Eid al-Adha holidays, IOF troops positioned at various checkpoints around Nablus imposed additional restrictions on the movement of Palestinian civilians. They also conducted prolonged checking on Palestinian civilians. On Sunday, 14 December 2008, IOF troops positioned at various checkpoints around Nablus imposed severe restrictions on the movement of Palestinian civilians.  

 

On Tuesday morning, 16 December 2008, IOF troops positioned at Za'tara checkpoint, south of Nablus, arrested Mahmoud Ahmed 'Ali, 20, from Tulkarm.

 

·      Jenin: IOF have continued to impose severe restrictions on the movement of Palestinian civilians. On Saturday morning, 13 December 2008, IOF erected a checkpoint in al-Jarba area between Qabatya and Masliuya villages, southeast of Jenin. They stopped and searched Palestinian civilian vehicles. On Sunday morning, 14 December 2008, IOF erected a checkpoint between 'Arraba and Fahma villages, southwest of Jenin. They stopped and searched Palestinian civilian vehicles. troops positioned at Ennab checkpoint, east of Tulkarm, imposed additional restrictions on the movement of Palestinian civilians. On Sunday, 22 November 2008, IOF troops positioned at Wad al-Teen checkpoint, south of Tulkarm, imposed additional restrictions on the movement of Palestinian civilians, and chased civilians who resorted to alternative roads. On Wednesday, 26 November 2008, IOF erected a checkpoint at the entrance of Shwaika suburb, north of Tulkarm. They stopped and searched dozens of Palestinian civilian vehicles.

 

·      Hebron: IOF have continued to impose severe restrictions on the movement of Palestinian civilians inside and around Hebron. On Thursday noon, 11 December 2008, IOF prevented the organization of a children festival in Friendship Park in the old town of Hebron, which was supposed to be attended by 700 Palestinian children from families that have been attacked by Israeli settlers. IOF troops prevented children from reaching the area.

 

At approximately 17:30 on Sunday, 14 December 2008, IOF troops positioned near the Ibrahimi Mosque in the old town in Hebron arrested Nabeel 'Abdul Khaliq Seder, 18.

 

·      Tulkarm: On Thursday, 4 December 2008, IOF troops in a patrol near "Avni Hevetz" settlement, southeast of Tulkarm, arrested Subhi Barqawi, 15, and Bahaa' Yassin Saleh, 20, when they were on agricultural lands in the area.

 

At approximately 08:00 on Tuesday, 16 December 2008, IOF troops positioned at Ennab checkpoint, east of Tulkarm, arrested Mousa Fa'eq 'Ouda, 22, from Tulkarm.

 

·      Al-Karama International Crossing Point: On Saturday evening, 13 December 2008, IOF troops positioned at al-Karama International Crossing Point on the Jordanian border arrested Mahmoud Ghunaimat, 56, from al-'Azza refugee camp north of Bethlehem, when he was on his way back to the West Bank.

 

 

4.     Construction of the Annexation Wall

IOF have continued to construct the Annexation Wall inside West Bank territory. During the reporting period, IOF used force against peaceful demonstrations organized by Palestinian civilians and international and Israeli human rights defenders in protest to the construction of the Wall. 

·      Following the Friday Prayer on Friday, 5 December 2008, scores of Palestinian civilians and international and Israeli human rights defenders demonstrated in Bal’ein village, west of Ramallah, in protest to the construction of the Wall. The demonstrators moved towards the Wall. Immediately, IOF troops fired rubber-coated metal bullets, tear gas canisters and sound bombs at the demonstrators. As a result, 2 Palestinian civilians, including a child, were wounded:

 

1.      Samer Mohammed Samara, 10, wounded by a rubber-coated metal bullet to the leg; and

2.      Hussam Kamal al-Khatib, 29, wounded by a rubber-coated metal bullet to the leg.

 

·      Following the Friday Prayer on Friday, 12 December 2008, scores of Palestinian civilians and international and Israeli human rights defenders demonstrated in Bal’ein village, west of Ramallah, in protest to the construction of the Wall. The demonstrators moved towards the Wall. Immediately, IOF troops fired rubber-coated metal bullets, tear gas canisters and sound bombs at the demonstrators. As a result, 2 Palestinian civilians, including a child, were wounded:

 

1.      Mohammed Bassem Yassin, 8, hit by a tear gas canister to the leg; and

2.      'Abed Hamamra, 37, hit by a tear gas canister to the leg.

 

·      Also following the Friday Prayer on Friday, 12 December 2008, dozens of Palestinian civilians and international and Israeli human rights defenders gathered in the center of Ne’lin village, west of Ramallah. They moved towards the area where IOF were razing land to construct a section of the Wall in the village. Immediately, IOF troops fired rubber-coated metal bullets and tear gas canisters at the demonstrators. As a result, 5 Palestinian civilians, including a child, were wounded:

 

1.      Mohammed Nemer al-Khawaja, 17, wounded by a rubber-coated metal bullet to the eye;

2.      Mahmoud 'Abdul Karim Sorour, 22, wounded by a rubber-coated metal bullet to the right leg;

3.      Waheed Tayseer Nafe', 51, wounded by a rubber-coated metal bullet to the head;

4.      Mohammed Fahmi Sorour, 22, wounded by a rubber-coated metal bullet to the left hand; and

5.      Mohammed 'Awadh, 26, wounded by a rubber-coated metal bullet to the back.

 

5.      Judaization of Jerusalem

IOF has recently escalated arbitrary measures against Palestinian civilians in East Jerusalem to force them to leave the city. For the purpose of reporting about violations of human rights perpetrated by IOF against Palestinian civilians in East Jerusalem, PCHR has decided to add a new section to the Weekly Report.

·      At approximately 07:30 on Tuesday, 16 December 2008, IOF stormed for the third time the land on which the al-Kurd family set up a tent in Sheikh Jarrah neighborhood in East Jerusalem. They forced Fawzia al-Kurd and solidarity activists out of the tent and arrested a number of them. They threw all contents of the tent out and took the tent. An Israeli bulldozer then leveled the land on which the tent was set up, which belongs to Kamal 'Obaidat. The Israeli Central Court had rejected an appeal by the family against a decision to confiscate the tent. Before their withdrawal from the area, IOF arrested Hussam al-Qawi and 3 international solidarity activists and warned Fawzia al-Kurd of setting up the tent again. It is worth noting that IOF seized Fawzia al-Kurd's house on 9 November 2008 and expelled the family from it. Since that date, Fawzia al-Kurd has lived in a tent set up near the house.

 

6.      Settlement Activities and Attacks by Settlers against Palestinian Civilians and Property

IOF have continued settlement activities in the OPT in violation of international humanitarian law, and Israeli settlers have continued to attack Palestinian civilians and property.

During the reporting period, Israeli settlers living in "Kiryat Arba" and "Kharsina" settlements and settlement outposts in the southeast and the center of Hebron launched a series of systematic terrorist attacks against Palestinian civilians and property in nearby Palestinian residential areas in Hebron. IOF provided protection for settlers. The settlers used firearms, empty bottles and stones in their attacks. A number of Palestinian civilians were wounded, 4 houses were burnt, 5 vehicles were destroyed and some other property was damaged.  

·      On Thursday morning, 4 December 2008, dozens of Israeli settlers living in "Kiryat Arba" settlement attacked Palestinian houses in al-Ras and Wadi al-Hussain neighborhoods using stones, iron bars and empty bottles. IOF troops were present in these areas. A number of those settlers threw flaming tires and substances at two houses belonging to Majdi Kayed al-Ja'bari and Ghaleb Mansour al-Ja'bari. Some trees in the gardens of the two houses were burnt. According to Palestinian civilians living in these areas, attacks by Israeli settlers have become much more violent and IOF troops have provided protection for settlers. IOF troops have been imposed severe restrictions on the movement of Palestinian civilians.

 

·      At approximately 14:30 on the same day, dozens of armed Israeli settlers attacked a number of Palestinian houses in Wadi al-Hussain neighborhood. The most serious of these attacks was against houses belonging to the Abu Su'aifan clan. The settlers stormed a number of these houses and burnt parts of them. When members of the clan attempted to protect themselves and their property, an Israeli settler fired at two members of the clan from a zero range. The two civilians were seriously wounded:

 

1.      'Abdul Hai Abu Husni Abu Su'aifan, 62, seriously wounded by a gunshot to the right arm, and some shrapnel to the upper part of the body; and

2.      Husni 'Abdul Hai Abu Su'aifan, 43, seriously wounded by a gunshot to the chest and shrapnel to the left leg.

 

The settlers attacked other houses in the same neighborhoods. They threw some flaming substances and pushed some flaming tires towards houses. Eight Palestinian civilians were injured and five houses were partially burnt. Scores of trees were also burnt. IOF prevented fire fighters and medical crews from entering the area and declared it as a closed military zone. Israeli settlers also attacked the crew of a fire engine. The civilians who were injured are:

 

1.      Nassar Mohammed al-Ja'bari, 49;

2.      Radwan Mohammed Ziada, 17;

3.      'Aadel Mohammed al-Ja'bari, 19;

4.      Jamal Jameel Abu Su'aifan, 45;

5.      Mohammed 'Abdul Hai Abu Su'aifan, 28;

6.      Hisham 'Abdul Hai Abu Su'aifan;

7.      Mohammed Fadel al-Razem, 22;

8.      Sa'id Mohammed Da'na, 37; and

9.      Ahmed Mohammed al-Ja'bari, 8.

 

·      At approximately 16:10 on the same day, Israeli settlers attacked Palestinian civilians and property in Jabal al-Rahma, al-Sahla and al-Karantina neighborhoods. Five Palestinian civilians were injured:

 

1.      'Abdul Ra'ouf l-Muhtasseb, 53;

2.      Amal 'Abdul Ra'ouf al-Muhtasseb, 17;

3.      Rajaa' 'Abdul Majeed al-Khatib, 50;

4.      Munjed 'Abdul Majeed al-Khatib, 15; and

5.      Razan 'Abdul Majeed al-Khatib, 11.

 

Two cars belonging to Salah Mohammed Seder and Ma'ath 'Abdul Moghni al-Sa'id were also damaged.

 

·      At approximately 18:00 on the same day, Israeli settlers living in "Kiryat Arba", "Kharsina" and "Hagai" settlements attacked Palestinian civilian vehicles traveling on a adjacent roads with stones and empty bottles. A number of vehicles were damaged.

 

·      On Friday, 5 December 2008, Israeli settlers living in "Kiryat Arba" settlement resumed their attacks against Palestinian houses in al-Ras and Wadi al-Hussain neighborhoods using firearms, stones, iron bars and empty bottles. IOF troops were present in the area. The settlers threw flaming substances at a house and some gardens. As a result of these attacks. Jadallah 'Abdul Halim Da'na, 22, was wounded by a gunshot to the right leg. At least 7 houses were also damaged.

 

In the same context, IOF transformed 9 houses in al-Ras, al-Masharqa, Wadi al-Hussain and al-Nassara neighborhoods into military sites.

 

·      At approximately 00:30 on Saturday, 6 December 2008, Israeli settlers living in "Abaraham Abinu" settlement outpost in the center of the old town of Hebron stormed a house belonging to Nidal al-'Owaiwi, in which 11 people live. They set fire to one of its room and damaged the kitchen. Some neighbors rushed to help the family. Two civilians suffered from smoke inhalation: Shihada Talab Jraiwi, 30; and 'Emad Abu Subaih, 38. The settlers also damaged water tanks of 5 houses in the area.

 

·      On Thursday evening and Friday morning, 11 and 12 December 2008, Israeli settlers living in settlement outposts in the center and around Hebron attacked Palestinian civilians and property in al-Karantina and Jabal al-Rahma neighborhood. The settlers used stones and iron bars in their attacks. They stormed a house and attempted to seize it. As a result of these attacks, a number of houses were damaged.

 

·      On Sunday noon, 14 December 2008, Israeli settlers attacked Palestinian civilians and property in al-Karantina neighborhoods in the southwest of Hebron using stones and iron bars. IOF troops fired at Palestinian civilians who attempted to protect themselves. As a result, Ya'qoub Salah al-Qasrawi, 14, was seriously wounded by a gunshot to the head.

 

Attacks in Other Areas

·      On Thursday morning, 4 December 2008, a number of Israeli settlers wrote insulting words against Prophet Mohammed on walls of a number of houses in some villages to the east of Qalqilya. The settlers also smashed windows of a number of cars.

 

·      At approximately 15:00 also on Thursday, Israeli settlers from "Shilo" and "Elli" settlements, north of Ramallah, blocked Nablus-Ramallah road from Turmos'iya intersection, north of Ramallah, to al-Lubban intersection, south of Nablus, with rocks. When Palestinian civilians resorted to an alternative road, Israeli settlers from "Ma'ale Livona" settlement closed it.

 

In the same context, dozens of Israeli settlers from "Yits'har" settlement, south of Nablus, gathered on Nablus-Ramallah road and closed it. IOF troops stationed in the area forced Palestinian civilian vehicles to travel towards Hawara checkpoint, south of Nablus, but Palestinian civilians were surprised by the presence of dozens of settlers there. The settlers threw stones and empty bottles towards civilian vehicles and Palestinian civilians who attempted to cross the checkpoint on foot. At approximately 18:00, IOF opened the checkpoint and forced all Palestinian civilian vehicles to travel to Nablus.

 

·      At approximately 10:00 on Friday, 5 December 2008, a number of Israeli settlers from "Evni Hevetz" settlement, which stands of the lands of Shoufa village, southeast of Tulkarm, uprooted 80 young olive trees belonging to 'Azmi Mousa Saleh. They also damaged the main water pumps of the village and added rocks to the sand barriers which IOF had already set up to close the sole entrance of the village.

 

·      On the same day afternoon, dozens of Israeli settlers from "Yits'har" settlement, south of Nablus, closed a bypass road located near the settlement and threw stones and empty bottles at Palestinian civilian vehicles. A number of vehicles were damaged.

 

·      At the same time, dozens of Israeli settlers from "Ma'ale Livona" settlement, north of Ramallah, closed the old Nablus-Ramallah road, and threw stones towards Palestinian civilian vehicles. One of those vehicle turned over and two passengers were injured:

 

1.      'Aatef Ibrahim Rasheed, 32, from 'Attil village north of Tulkarm; and

2.      Samah Hussam Bassalat, 29, from Qalqilya.

 

·      On Wednesday evening, 10 December 2008, a number of Israeli settlers from "Shavi Shomron" settlement, northwest of Nablus, broke into Sabastia village and opened fire to terrify Palestinian civilians. They left the village when IOF arrived.

Recommendations to the International Community

1.      PCHR calls upon the High Contracting Parties to the Fourth Geneva Convention to fulfill their legal and moral obligations under Article 1 of the Convention to ensure Israel's respect for the Convention in the Occupied Palestinian Territory.  PCHR believes that the conspiracy of silence practiced by the international community has encouraged Israel to act as if it is above the law and encourages Israel continue to violate international human rights and humanitarian law.

 

2.      PCHR calls upon the High Contracting Parties to the Fourth Geneva Convention to convene a conference to take effective steps to ensure Israel's respect of the Convention in the OPT and to provide immediate protection for Palestinian civilians.

 

3.      PCHR calls upon the High Contracting Parties to the Fourth Geneva Convention to comply with its legal obligations detailed in Article 146 of the Convention to search for and prosecute those responsible for grave breaches, namely war crimes.

 

4.      PCHR calls for the immediately implementation of the Advisory Opinion issued by the International Court of Justice, which considers the construction of the Annexation Wall inside the West Bank illegal.

 

5.      PCHR recommends international civil society organizations, including human rights organizations, bar associations and NGOs to participate in the process of exposing those accused of grave breaches of international law and to urge their governments to bring these people to justice.

 

6.      PCHR calls upon the European Union to activate Article 2 of the Euro-Israel Association Agreement, which provides that Israel must respect human rights as a precondition for economic cooperation between the EU states and Israel.  PCHR further calls upon the EU states to prohibit import of goods produced in illegal Israeli settlements in the OPT.

 

7.      PCHR calls on the international community to recognize the Gaza disengagement plan, which was implemented last year, for what it is - not an end to occupation but a compounding of the occupation and the humanitarian crisis in the Gaza Strip. 

 

8.      In recognition of ICRC as the guardian of the Fourth Geneva Convention, PCHR calls upon the ICRC to increase its staff and activities in the OPT, including the facilitation of family visitations to Palestinian prisoners in Israeli jails.

 

9.      PCHR appreciates the efforts of international civil society, including human rights organizations, bar associations, unions and NGOs, and urges them to continue their role in pressuring their governments to secure Israel's respect for human rights in the OPT and to end its attacks on Palestinian civilians.

 

10.  PCHR calls upon the international community to pressure Israel to lift the severe restrictions imposed by the Israeli government and its occupation forces on access for international organizations to the OPT.

 

11.  PCHR reiterates that any political settlement not based on international human rights law and humanitarian law cannot lead to a peaceful and just solution of the Palestinian question.  Rather, such an arrangement can only lead to further suffering and instability in the region.  Any peace agreement or process must be based on respect for international law, including international human rights and humanitarian law.
